Geofencing during shift only (not 24/7 tracking) is the privacy-safe positioning.

29 C.F.R. § 785.48(b) · DOL Opinion Letter FLSA2026-8
FLSA overtime & auto-rounding
Rounding to 5, 6 or 15 minutes is allowed only if it's neutral and averages out. Rounding early clock-ins forward while cutting late clock-outs systematically underpays — that's wage theft.
Liability exposure
- 7-minute rule: 8:01–8:07 rounds to 8:00; 8:08–8:14 rounds to 8:15
- Asymmetric rounding that favors the employer violates § 785.48(b)
- California (Camp v. Home Depot): if the system captures exact minutes, you can't round them away
- Washington: no rounding on meal/rest break calculations
How Connecteam helps
- Immutable raw punch timestamps
- Disable rounding entirely in strict states — pay exact minutes
- Where permitted, configure rounding neutrally on both entry and exit
Discovery question
"How are you rounding punches today — and could you prove to an auditor it's neutral in both directions?"
